General Conditions of Sale (GCS) of Liveli Créations


Preamble

These General Terms and Conditions of Sale (GTC) apply to all orders placed on the Liveli Créations online jewelry sales site, operated by Lisa GOVERNATO, self-employed, registered under number [SIRET number], whose head office is located at 114 Traverse Marius, 13360 Roquevaire, France. By placing an order on the website www.livelicreations.com, you unreservedly accept these general terms and conditions of sale.

1. Purpose

These General Terms and Conditions define the rights and obligations of the parties in the context of the sale of products by Liveli Créations to customers of the website www.livelicreations.com.

2. Products

The jewelry offered for sale is that which appears on the site on the day of consultation by the user. Each product is accompanied by a description established by Liveli Créations. The product photographs are as faithful as possible but cannot guarantee a perfect similarity with the product offered, particularly with regard to colors.

3. Rates

Prices are listed in euros (€) inclusive of all taxes (TTC), excluding delivery charges. Liveli Créations reserves the right to modify its prices at any time, it being understood that the price listed in the catalog on the day of the order will be the only one applicable to the customer.

4. Order

Orders are placed exclusively on the website www.livelicreations.com. Any order constitutes acceptance of the prices and descriptions of the products available for sale. Liveli Créations will acknowledge receipt of the order by sending a confirmation email. The sale will be considered final after sending this confirmation email and receipt of the total price of the order.

5. Payment terms

Payment is due immediately upon ordering. Customers can pay for their order by credit card via a secure payment platform. Liveli Créations reserves the right to suspend any order processing and delivery in the event of a credit card payment authorization refusal by officially accredited organizations.

6. Delivery

Products are delivered to the delivery address specified by the customer when ordering. Liveli Créations undertakes to ship the products within 2 to 7 business days after receipt of payment. In the event of a shipping delay, an email will be sent to the customer to inform them of any impact on the indicated delivery time.

Incorrect Shipping Address : It is the customer's responsibility to provide an accurate and complete shipping address when placing an order. In the event of an incorrect shipping address attributable to the customer, Liveli Créations cannot be held responsible for any delays, incorrect deliveries, or lost packages resulting from this error. If a package is returned to Liveli Créations due to an incorrect address provided by the customer, the customer will be contacted to arrange for a new shipment at their expense. No refunds will be issued for packages delivered to an incorrect address provided by the customer.

7. Right of withdrawal

In accordance with current legislation, the customer has 14 days from receipt of the products to exercise their right of withdrawal without having to provide a reason or pay a penalty. Return costs are the customer's responsibility. Products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be resold as new.

8. Claims related to delivery

The customer is required to carefully check the condition of their package and its contents upon receipt. Any anomalies (damaged package, missing or incorrect item, etc.) must be reported by email to contact.liveliparis@gmail.com within a maximum of 14 calendar days following the delivery date indicated by the carrier.

After this period, no claims will be accepted. In the event of non-receipt of the package, the customer has 30 calendar days from the date of shipment to inform Liveli Créations, so that an investigation can be opened with the carrier.

If the package tracking indicates that it has been delivered to the address provided by the customer, the order will be considered duly executed and will not give rise to any refund or return, unless proven otherwise by the customer.

It is the customer's responsibility to provide accurate and complete delivery information when placing an order. Liveli Créations cannot be held responsible for any loss or delay due to an incorrect address attributable to the customer.

9. Return and refund

If you exercise your right of withdrawal, Liveli Créations will refund the amount paid within 14 days of receiving your request and using the same payment method used when placing your order. Damaged, soiled, or incomplete products will not be accepted.

10. Guarantees

All products supplied by Liveli Créations benefit from the legal guarantee of conformity provided for by Articles L.217-4 et seq. of the French Consumer Code and the guarantee against hidden defects provided for by Articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to Liveli Créations, which will take it back, exchange it, or refund it.

11. Intellectual Property

All elements of the website www.livelicreations.com are and remain the exclusive intellectual property of Liveli Créations. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual, or audio.

12. Personal data

Liveli Créations is committed to maintaining the confidentiality of the information provided by the customer, which the customer may be required to transmit for the use of certain services. All information concerning the customer is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the user has the right to access, modify, and delete information concerning him or her, which he or she may exercise at any time by sending a letter to the following address: contact.liveliparis@gmail.com.

13. Dispute Resolution

These online sales conditions are subject to French law. In the event of a dispute, jurisdiction shall be granted to the competent courts of [city], notwithstanding multiple defendants or third-party claims.
